ZusammenfassungDer heutige Arbeitsalltag im medizinischen Betrieb ist durch verschiedene Belastungsfaktoren gekennzeichnet: 1) die Tempobeschleunigung und die Komplexitätssteigerung der medizinischen Entwicklung allgemein sowie 2) eine zunehmende moralische Verunsicherung des Personals in Bezug auf das Verhältnis von Möglichkeiten und Notwendigkeiten bestimmter therapeutischer Verfahren. Die in diesem Aufsatz vorgelegten Beobachtungen, die aus einem Projekt am Lehrstuhl für Ethik der Georg-August-Universität Göttingen resultieren, machen noch einen weiteren Punkt geltend, so dass 3) bereits die unterschiedliche Einschätzung rein sachlicher Fragen zu einem Dissens führen kann, der (...) als moralischer empfunden wird. Aus diesen drei Momenten erwächst ein allgemeiner Bedarf an ethischer Handlungsorientierung. Allerdings ist die Entlastung, die durch ethische Kommunikation, beispielsweise in klinischen Ethik-Komitees, erreicht wird, anderer Art als zunächst in der Regel erwartet. Denn die Leistung liegt nicht so sehr in der Lösung von Problemen als vielmehr in deren Beschreibung. (shrink)

ZusammenfassungDie Beschäftigung mit der ethischen Dimension des ärztlichen Handelns beruht auf der freiwilligen Einsicht in deren Notwendigkeit. Es stellte sich die Frage, ob die Anwesenheit von Studierenden, die nur durch den Zwang des Stundenplans Ethikseminare besuchen, die Qualität der Veranstaltungen messbar negativ beeinflusst. In einer über 2 Jahre umfassenden Umfrage zu Lernzielen, Unterrichtsatmosphäre, Moderation und Fächerwichtigkeiten wurden die Ethikseminare an der Universität Ulm evaluiert. Hierzu bekamen wir Fragebögen von 192 freiwillig Teilnehmenden des Jahrgangs 2001/2002 und von 293 Pflichtteilnehmern des Jahrgangs (...) 2002/2003 zurück. Überraschenderweise gab es bei keiner relevanten Frage oder Bewertung einen statistisch signifikanten Unterschied zwischen freiwilligen und Pflichtteilnehmern. Zum Teil deutliche Unterschiede zeigten sich zwischen männlichen und weiblichen Studierenden. Diese Unterschiede müssen aufgrund ihrer didaktischen und konzeptionellen Bedeutung weiterverfolgt werden. Das Umfrageergebnis lässt hoffen, dass das Unterrichtskonzept der fallorientierten Kleingruppenseminare die Lernziele bei allen Studierenden verwirklichen kann. (shrink)

Staaten beanspruchen für sich das Recht, Gesetze geben und mit Zwangsgewalt durchsetzen zu dürfen. Doch unter welchen Bedingungen haben sie dieses Recht tatsächlich? -/- Das ist die grundlegendste Frage der Politischen Philosophie. Obwohl wir die Autoritätsansprüche des Staates oft als selbstverständlich hinnehmen, erscheinen sie moralisch durchaus fragwürdig, wenn man Personen als frei und gleich begreift. Wie können wenige Parlamentsmitglieder das Recht haben, für Millionen Menschen verbindliche Gesetze zu erlassen? Wie können Polizeibeamte und Richter das Recht haben, diese Gesetze gegenüber Personen (...) durchzusetzen, die sie ablehnen? In diesem kurzen, verständlichen und anregenden Buch stellt Fabian Wendt die fünf wichtigsten Theorien politischer Autorität aus der zeitgenössischen Politischen Philosophie vor. Er diskutiert darüber hinaus den Anarchismus, der als Alternative ernst zu nehmen ist, falls alle Begründungsversuche politischer Autorität fehlschlagen sollten. (shrink)

Patientenselbstbestimmung und Patientenverfügungen haben zunehmende Bedeutung und Beachtung erfahren. In der vorliegenden qualitativen Studie wurden 15 Patientinnen und Patienten mit amyotropher Lateralsklerose —einer unheilbaren, chronisch-degenerativen Erkrankung mit vorhersehbarer Symptomatik—interviewt, um zu erfahren, welche Werte und Kriterien sie bei prospektiven Entscheidungen am Lebensende und bei der Abfassung von PV zugrunde legen. Die Auswertung erfolgte nach der Methode der „grounded theory“. Die befragten Patientinnen und Patienten befürworteten einen Verzicht auf lebenserhaltende Behandlungen, wenn sie keine hinreichenden Lebensmöglichkeiten mehr sahen, d. h. wenn sie (...) die aktuelle Lebensqualität für unzureichend erachteten und die Chance auf Besserung als gering einschätzten. Dem Patientenwillen sprachen sie bei der Entscheidungsfindung ein Vetorecht zu. Patientenverfügungen fassten sie erst ab, als sie keine Hoffnung mehr auf Besserung ihrer Erkrankung hatten. Sie verstanden diese als Instrumente zur vorsorglichen Erklärung ihres Wunsches, auf lebensverlängernde Maßnahmen zu verzichten, wenn die LM inakzeptabel geworden sind. Damit wollten sie sich gegenüber dem Arzt absichern, den sie in der Rolle eines Anwalts des Lebens sahen und mit dem sie daher ihre Behandlungswünsche nicht besprochen haben. Trotz vorhersehbarer Symptomatik legten sie in ihren PV keine spezifischen Behandlungswünsche nieder, sondern verwendeten allgemeine Formularmuster ohne konkreten Bezug zu ihrer Erkrankung. Daher bestehen auch bei dieser Patientengruppe Zweifel, ob die PV in einer konkreten Behandlungssituation hilfreich sind. (shrink)

The author argues that peace and public justification are values that provide moral reasons to make compromises in politics, including compromises that establish unjust laws or institutions. He explains how it is possible to have moral reasons to agree to moral compromises and he debates our moral duties and obligations in making such compromises. The book also contains discussions of the sources of the value of public justification, the relation between peace and justice, (...) the nature of modus vivendi arrangements and the connections between compromise, liberal institutions and legitimacy. In exploring the morality of compromising, the book thus provides some outlines for a map of political morality beyond justice. (shrink)

A REALIDADE DAS SERRAS CENTRAIS POTIGUARES E A QUESTÃO DO DESENVOLVIMENTO REGIONAL SOB A PERSPECTIVA DO DIREITO, DESENVOLVIMENTO E SUSTENTABILIDADE.

Este ensaio tem como objetivo afirmar a leitura e a escrita enquanto processo ativo tradutório, por meio da reimaginação do Texto de Partida As cidades invisíveis, redigido em 1972 pelo autor italiano Ítalo Calvino. O ensaio é tecido mediante a noção de fragmentos, tal como entendido por Tavares, em que a escrita se constitui como uma experimentação do pensamento. Toma como ponto de partida as pistas deixadas pelo viajante Marco Polo, na obra de Calvino, a qual foi lida e reinventada (...) pelos acadêmicos do Curso de Pedagogia de uma Instituição de Ensino Superior localizada no interior do Rio Grande do Sul. Um Roteiro de Procedimentos Escrileitores – escritura e leitura – das Cidades de Calvino foi disponibilizado aos estudantes, tendo como proposição mostrar nove regras, cujo objetivo consistiu em servir à operação tradutório-inventiva. A partir delas, os estudantes arriscaram uma leitura ativa e uma escritura viva, ou seja, uma escritura tradutória, que não visa à recuperação literal do texto, mas privilegia uma escrileitura inventiva e traduções-reinvenções. Como aporte teórico, o texto aproxima-se do pensamento da diferença, de Roland Barthes, de Gilles Deleuze, além das teorizações da tradução literária propostas por Haroldo de Campos. Trata-se de experimentar a prática da leitura e o ensaio da escrita gerando novas interpretações ao Texto de Partida. Nesse sentido, ler-e-escrever configuram-se como uma prática aberta, jamais definitiva e tampouco estática. Em síntese, o texto propõe defender que os Textos de Partida são sempre fisgados pelos processos tradutórios e, por isso, novamente reinventados via leitura e escrita em Textos de Chegada. This book offers an original account of a distinctly republican theory of social and global justice. The book starts by exploring the nature and value of Hegelian recognition theory. It shows the importance of that theory for grounding a normative account of free and autonomous agency. It is this normative account of free agency which provides the groundwork for a republican conception of social and global justice, based on the core-ideas of freedom as non-domination and autonomy as non-alienation. As the (...) author argues, republicans should endorse a sufficientarian account of social justice, which focuses on the nature of social relationships and their effects on people's ability to act freely and realize their fundamental interests. On the global level, the book argues for the cosmopolitan extension of the republican principles of non-domination and non-alienation within a multi-level democratic system. In so doing, the book addresses a major gap in the existing literature, presenting an original theory of justice, which combines Hegelian recognition theory and republican ideas of freedom, and applying this hybrid theory to the global domain. Fabian Schuppert creates a grand synthesis uniting neo-republican insights on freedom with Hegelian recognition theory. The result is an account of agency that arises from the idea of non-domination whose aim it is to safeguard individual freedom. When combined with Hegelian recognition theory a social focus also emerges. This amalgam comments on many of the major disputes concerning global justice from a cosmopolitan perspective. Because of the broad scope and the many contemporary discussions engaged this book will be of keen interest to scholars as well as a welcome addition to the classroom. (shrink)

Adorno notoriously asserted that there is no 'right' life in our current social world. This assertion has contributed to the widespread perception that his philosophy has no practical import or coherent ethics, and he is often accused of being too negative. Fabian Freyenhagen reconstructs and defends Adorno's practical philosophy in response to these charges. He argues that Adorno's deep pessimism about the contemporary social world is coupled with a strong optimism about human potential, and that this optimism explains his (...) negative views about the social world, and his demand that we resist and change it. He shows that Adorno holds a substantive ethics, albeit one that is minimalist and based on a pluralist conception of the bad - a guide for living less wrongly. His incisive study does much to advance our understanding of Adorno, and is also an important intervention into current debates in moral philosophy. (shrink)

Johannes Fabian is widely known outside of his discipline because his work so often overcomes traditional scholarly boundaries to bring fresh insight to central topics in philosophy, history, and cultural studies. The first part of the book addresses questions of current critical concern. The second part extends the work of critique into the past by examining the beginning of (...) modern ethnography in the exploration of Central Africa during the late nineteenth century: the justification of a scientific attitude and the collecting of ethnographic objects. A final essay examines how the Congolese have returned the 'imperial gaze' of Belgium by the work of critical memory in popular history. Immersion is an availability, a submersion, a diving and, in case of distraction/inattention, a downright drowning. It is about perceiving a certain fortuitous or yielded space-time, an either individual or collective tendency in order to create situations of resistance to environmental, political and social contemporaries paradigms. The creation of new network combinations in space-time immersing are devices that spark new forms of politics making as well as new ways to be in the world. The events « interference STD/AIDS », « (...) Economists, in stressing the prescriptive implications of their analysis, typically have ignored the potential contributions of their theorems and methodological principles to the understanding of human behavior as an end in itself. The purpose of the paper is to establish the principle, by detailed reference to the literature of economics, that the 'deductive pattern of explanation' constitutes a valid approach to the general study of human behavior. As such, it is a potentially useful method of analysis in the other social (...) sciences. Literature from the philosophy of social science bearing on the applicability of deductive theory to the study of human behavior is subjected to detailed critical analysis. (shrink)

Die Einführung der kostenkalkulierten und landesweit einheitlich bepreisten DRGs hat die Möglichkeiten gewinnorientierter Krankenhausträger, ehemals kommunale, defizitäre Krankenhäuser in die Gewinnzone zu führen, erschwert. Diese reagieren darauf mit dem Einsatz bisher nicht gekannter Werkzeuge wie beispielsweise der Steuerung von Patientenströmen, Anreizsystemen, Gründung von Privatkliniken sowie erlösorientierten Therapien und Abrechnungen. Mittlerweile bedienen sich auch andere Trägergruppen dieser Instrumente, so dass sich die Frage stellt, ob angesichts der Wettbewerbssituation nicht gewinnorientierte Träger eines besonderen wirtschaftlichen Schutzes bedürfen, damit die bisher im Krankenhaus gültigen (...) ethischen Prinzipien auch weiterhin Anwendung finden können. This commentary challenges Michael Scliefczyk’s proposal for a realistically utopian welfare state (RUWS). As it stands, RUWS says too little about the concrete measures it will offer to avoid political domination and harmful inequalities. Moreover, RUWS follows Rawlsian Property-Owning Democracy (POD) by being silent on crucial issues such as banking regulation, the governance of investments and the issue of actual control over capital. Ultimately, it therefore seems that RUWS does not present an attractive alternative to POD since it suffers from (...) very similar problems and shortcomings as POD. (shrink)

While John Rawls made the notion of a “modus vivendi” prominent in political philosophy, he treats modus vivendi arrangements rather short and dismissively. On the other hand, some political theorists like John Gray praise modus vivendi as the only available and legitimate goal of politics. In the article I sketch the outlines of a different, more nuanced approach to modus vivendi arrangements. I argue that the moral standing of modus vivendi arrangements varies, and I try to spell out the factors (...) that determine the relative moral standing of modus vivendi arrangements. (shrink)

In his paper, The Transparency of Experience, M.G.F. Martin has put forward a well- known – though not always equally well understood – argument for the disjunctivist, and against the intentional, approach to perceptual experiences. In this article, I intend to do four things: (i) to present the details of Martin’s complex argument; (ii) to defend its soundness against orthodox intentionalism; (iii) to show how Martin’s argument speaks as much in favour of experiential intentionalism as it speaks in favour of (...) disjunctivism; and (iv) to argue that there is a related reason to prefer experiential intentionalism over Martin’s version of disjunctivism. Perceptual representations are either correct or incorrect. Their correctness depends on their content and on the way the world is. Teleosemantics delivers compelling explanations of why our perceptual representations have contents, whereby it assigns the notion of "function" a central explanatory role. The author of this thesis engages in the search for a theory of function suited for this purpose. From citizens paying taxes to employees following their bosses’ orders and kids obeying their parents, we take it for granted that a whole range of authorities have the power to impose duties on others. However, although authority is often accepted in practice, it looks philosophically problematic if we conceive persons as free and as equals. -/- In this short and accessible book, Fabian Wendt examines the basis of authority, discussing five prominent theories that try to explain how claims to (...) authority can be vindicated. Focusing in particular on the issue of how states can rightfully claim authority, he rigorously analyses the theories’ arguments and evaluates their strengths and weaknesses. Theodor W. Adorno inspired much of Germany’s 1960s student movement, but he came increasingly into conflict with this movement about the practical implications of his critical theory. Others – including his friend and colleague Herbert Marcuse – also accused Adorno of a quietism that is politically objectionable and in contradiction with his own theory. In this article, I recon- struct, and partially defend, Adorno’s views on theory and (political) praxis in Germany’s 1960s in 11 theses. His often attacked and maligned (...) stance during the 1960s is based on his analysis of these historical circumstances. Put provocatively, his stance consists in the view that people in the 1960s have tried to change the world, in various ways; the point – at that time – was to interpret it. (shrink)

Around the globe, economists affect markets by saying what markets are doing, what they should do, and what they will do. Increasingly, experimental economists are even designing real-world markets. But, despite these facts, economists are still largely thought of as scientists who merely observe markets from the outside, like astronomers look at the stars. Do Economists Make Markets? boldly challenges this view. Over the last two decades, Axel Honneth has written extensively on the notion of social pathology, presenting it as a distinctive critical resource of Frankfurt School Critical Theory, in which tradition he places himself, and as an alternative to the mainstream liberal approaches in political philosophy. In this paper, I review the developments of Honneth's writing on this notion and offer an immanent critique, with a particular focus on his recent major work "Freedom's Right". Tracing the use of, and problems (...) internal to, Honneth's concept of social pathology serves to demonstrate his increasing reformism. It also serves to catalogue some of the dead ends that Critical Theory should avoid in taking up the idea of social pathology. The implication is not that this idea should be dropped. Rather, the paper is undertaking the necessary step of clearing the ground for further progress to take place on the question of what role the idea of social pathology can and should play in Critical Theory. The paper is critical in nature (and relentlessly so), but ultimately serves a constructive purpose. (shrink)

International debates surrounding the management of universities in Western states have focused heavily upon the implications of neo-liberalism and the economisation of knowledge at national and international levels. However, investigations at the institutional level reveal that programmes for the development of human capital, organisational reputation and service quality in education and research are encouraged through regimes of self-development, directed towards organisational objectives. This article utilises governmentality theory to explore the relationship between governance and subjectivity within the Australian higher education system. (...) The governance of higher education, it will be argued, is enabled by mentalities of government which are dependent upon contemporary technologies, techniques for self-evaluation and career-planning, expertise about university labour, and—importantly—practices which engender an enterprising academic identity. To explore the utility of this analysis in contemporary Western liberal states, this study explores the construction of subjectivity implicit within Monash University’s Performance Development Online technology. Embedded with “technologies of the self,” this performance management platform is positioned within Monash as a gateway which requires academics to reflect upon their careers and selves, encouraging the genesis of marketable identities. This article points to the utility of further research into the development of career in a changing academic environment. (shrink)
